公积金缴纳比例有两个档次，分别是按照5%的比例缴纳公积金，或是按照12%的比例缴纳公积金。其中单位和个人缴纳比例是相同，要选12%公积金缴纳比例的话，企业和个人的比例都是12%。住房公积金由两部分组成，一部分由职工所在单位缴存，另一部分由职工个人缴存，职工个人缴存部分由单位代扣后，连同单位缴存部分一并缴存到住房公积金个人账户内。住房公积金缴存比例的规定是：
1、职工和单位住房公积金例不得低于职工上一年度月平均工资的5％；
2、有条件的城市可以适当提高缴存比例；
3、具体缴存比例由住房公积金管理委员会制定，经同级人民政府审核后，报省、自治区、直辖市人民政府批准。
有关法律规定，职工住房公积金月缴存额为职工上一年度月平均工资乘以职工住房公积金缴存比例。职工缴纳的住房公积金月缴存额为职工上一年度月平均工资乘以单位住房公积金缴存比例。
【法律依据】：《住房公积金管理条例》 第十八条 职工和单位住房公积金的缴存比例均不得低于职工上一年度月平均工资的5%；有条件的城市，可以适当提高缴存比例。具体缴存比例由住房公积金管理委员会拟订，经本级人民政府审核后，报省、自治区、直辖市人民政府批准。
