释义	法律分析：如果被恶意保全，属于申请保全的人的过错，可以要求赔偿。协商不成可以起诉解决。如果申请财产保全妨害了对方的正常生产、经营行为，又无助于自己债权的实现，应该视为恶意。对于申请人是出于报复、泄愤心理，以干扰对方正常生产经营为目的，恶意要求保全对方财产的可以要求进行赔偿。法律依据：《中华人民共和国民事诉讼法》第一百零三条财产保全采取查封、扣押、冻结或者法律规定的其他方法。人民法院保全财产后，应当立即通知被保全财产的人。财产已被查封、冻结的，不得重复查封、冻结。
