释义	法律分析：保险合同是投保人与保险人约定保险权利义务关系的协议。保险合同除了具有一般合同的双务有偿性质以及诺成合同的特征外，还具有如下法律特征:(1)保险合同是不要式合同。(2)保险合同是附合合同。(3)保险合同是射幸合同。法律依据：《中华人民共和国保险法》第十条　保险合同是投保人与保险人约定保险权利义务关系的协议。投保人是指与保险人订立保险合同，并按照合同约定负有支付保险费义务的人。保险人是指与投保人订立保险合同，并按照合同约定承担赔偿或者给付保险金责任的保险公司。
