释义	保释，在中国称之为取保候审，是指侦查、起诉和审判机关在刑事诉讼过程中，对被刑事追诉而又未被刑事羁押之人，为防止其逃避侦查、起诉和审判，责令其提出保证人或交纳保证金，并出具保证书，以保证随传随到的一种刑事强制措施。因此，在我国取保候审之中的“保证”，不仅有被保释人的“保证”，还应包括财产的担保或他人的担保；而所候之“审”，除了法院的审判外，还包括侦查机关和起诉机关之传讯。保释金就是取保候审所用的金钱，即保证金。
