释义	法律分析：开发商网签后在还没有备案的情况下也不能退房。对开发商不备案的原因要及时跟开发商沟通，因为根据《城市商品房预售管理办法》的规定，在网签后的30天之内，开发商房管局办理备案，一般只要网签了，开发商不会不备案的。法律依据：《最高人民法院关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》第二条出卖人未取得商品房预售许可证明，与买受人订立的商品房预售合同，应当认定无效，但是在起诉前取得商品房预售许可证明的，可以认定有效。
