释义	一般情况下行为人故意报假案的，公安机关会根据所造成的后果是否严重来依据《治安管理处罚法》对其起处以行政拘留和罚款。法律依据：《中华人民共和国民刑法》第二百四十三条捏造事实诬告陷害他人，意图使他人受刑事追究，情节严重的，处三年以下有期徒刑、拘役或者管制；造成严重后果的，处三年以上十年以下有期徒刑。最高司法机关认定该条规定的犯罪是诬告陷害罪。不是有意诬陷，而是错告，或者检举失实的，不适用前两款的规定。
