释义	法律分析：公民从出生时起具有民事权利能力。我国法律没有明确赋予胎儿民事权利能力，但是在继承法领域却有明确规定保护胎儿的继承利益。法律依据：《中华人民共和国民法典》第一千一百五十五条遗产分割时，应当保留胎儿的继承份额。胎儿娩出时是死体的，保留的份额按照法定继承办理。可见，虽然开始继承时胎儿还没有出生，但是，法律还是规定应当保留胎儿的一定继承利益。
