释义	法律分析: 虚假出资、抽逃出资的股东享有股东权。虚假出资的股东应当补足出资，同时可能受到罚款的行政处罚，抽逃出资者经过催告仍不返还出资的，可以作出决议解除其股东的资格。《公司法》第二百条公司的发起人、股东在公司成立后，抽逃其出资的，由公司登记机关责令改正，处以所抽逃出资金额百分之五以上百分之十五以下的罚款。第二百零一条公司违反本法规定，在法定的会计账簿以外另立会计账簿的，由县级以上人民政府财政部门责令改正，处以五万元以上五十万元以下的罚款。
