释义	法律分析: 间接故意是指行为人明知自己的行为会发生危害社会的结果，并且放任这种结果发生的主观心理态度。不作为是指行为人负有实施某种行为的特定义务，能够履行而不履行的危害行为。《中华人民共和国刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
