释义	法律分析: 出售无证房产的房屋买卖合同没有效，在起诉前卖方已经登记领取房产证或者已经具备办理登记领取房产证条件的，可以认定买卖合同有效。否则，房屋买卖合同认定无效。法律依据: 《中华人民共和国城市房地产管理法》第三十八条第(六)项“未依法登记领取权属证书的房屋不得转让”的规定，认为合同无效，拒绝履行合同。
