赌博属于违法犯罪行为，酒店明知客人在酒店内赌博，而放任赌博，为赌博提供条件的，公安机关查获后，应对酒店服务员和法人进行处罚。
法律依据：
《中华人民共和国治安管理处罚法》 第七十条 以营利为目的，为赌博提供条件的，或者参与赌博赌资较大的，处5日以下拘留或者500元以下罚款；情节严重的，处10日以上15日以下拘留，并处500元以上3000元以下罚款。
