释义	法律分析：工程承包单位承包了建设工程之后，未经发包人同意，以赢利为目的，将其承包的全部建设工程转给他人或者将其承包的全部建设工程肢解以及以分包的名义分别转给其他单位承包并不对所承包工程的技术、管理、质量和经济承担责任的行为。法律依据：《中华人民共和国建筑法》第二十八条明确规定，禁止承包单位将其承包的全部建筑工程转包给他人，禁止承包单位将其承包的全部建筑工程肢解以后以分包的名义分别转包给他人。由此看出，转包是一种法律禁止的行为，其本身就是不合法的。
