释义	1.其已再婚配偶不构成重婚。根据法律规定,宣告死亡的效力等同于自然死亡,婚姻关系因一方的死亡自动解除,所以在一方被宣告死亡时,其婚姻关系已经消灭,其配偶有再婚的权利。2.虽然法律规定了被宣告死亡人归来的,其原婚姻关系自行恢复,但是自行恢复的前提是其配偶没有再婚、再婚又离婚或者再婚后配偶又死亡的情况,如果有这些情况,夫妻关系不能自行恢复。所以其配偶再婚不构成重婚。法律依据《中华人民共和国民法典》第四十六条、第一千零七十九条
