释义	法律分析：紧急避险过当并没有单独的罪名，它只是一种特殊的犯罪形态。紧急避险过当造成了不应有的损害，从客观方面看，无非是财产的损失和人员的伤亡。根据我国刑法的规定及犯罪构成原理，仅有客观方面的损害，无论这个损害有多大，都不能仅仅根据这一点来认定行为人有罪，即不能客观归罪。法律依据：《中华人民共和国刑法》第二十一条第二款紧急避险超过必要限度造成不应有的损害的，应当负刑事责任，但是应当减轻或者免除处罚。
