释义	法律分析: 监察委员会既非侦查机关、也非司法机关，其无法自行启动刑事诉讼程序，检察机关必须依职权对监察机关移送之“监察案件”予以转化，按照管辖范围进行刑事立案。唯此，审查起诉方有依据，职务犯罪案件的刑事诉讼程序才能继续进行。法律依据: 《中华人民共和国监察法》第十七条上级监察机关可以将其所管辖的监察事项指定下级监察机关管辖，也可以将下级监察机关有管辖权的监察事项指定给其他监察机关管辖。监察机关认为所管辖的监察事项重大、复杂，需要由上级监察机关管辖的，可以报请上级监察机关管辖。
