公司给员工多发工资应该如何去 |

公司给员工多发工资的处理方法如下：
1、公司发现多发工资给员工后，可以要求员工退还，员工也要主动将多发的工资退还，如果员工不退还的，就会造成不当得利，按法律的规定也需要退还。
2、没有合法根据，取得不当利益，造成他人损失的，应当取得的不当利益返还受损失的人。因过失而不知道的，视为善意。此种返还义务以现存利益为限。
3、 没有合法根据，取得不当利益，造成他人损失的，应当将取得的不当利益返还受损失的人。
如果是用工单位疏忽大意错误导致多发了钱，多发的钱属于不当得利，应当及时返还用工单位。如果拒不返还的，如果该多发的金额在1000元以上的，可能涉嫌侵占罪，有可能会被处二年以下有期徒刑、拘役或者罚金。

第九百八十五条
得利人没有法律根据取得不当利益的，受损失的人可以请求得利人返还取得的利益，但是有下列情形之一的除外：
（一）为履行道德义务进行的给付；

（三）明知无给付义务而进行的债务清偿。
第九百八十七条
得利人知道或者应当知道取得的利益没有法律根据的，受损失的人可以请求得利人返还其取得的利益并依法赔偿损失。
