赌博行为和群众娱乐活动的区分：
1、看是否从中抽头获利，构成赌博罪客观上以"聚众赌博"、"开设赌场"或"以赌博为业"三种行为为限。
2、从主观方面看，是否以营利为目的，它是构成赌博罪的主观要件；群众娱乐以休闲消遣为目的。
法律依据：
《刑法》 第三百零三条
以营利为目的，聚众赌博或者以赌博为业的，处三年以下有期徒刑、拘役或者管制，并处罚金。
开设赌场的，处三年以下有期徒刑、拘役或者管制，并处罚金；情节严重的，处三年以上十年以下有期徒刑，并处罚金。
