释义	法律分析: 待审羁押与拘留的区别:拘留是在未批准逮捕以前，在法定的条件下，对需要进行侦查的人犯采取的一种紧急措施，执行机关是公安机关；而羁押是在人民法院决定逮捕或者人民检察院批准逮捕，并在实施逮捕以后，把人犯羁押起来；执行机关是人民法院、人民检察院和公安机关。法律依据:《《中华人民共和国刑事诉讼法》》第九十四条人民法院、人民检察院对于各自决定逮捕的人，公安机关对于经人民检察院批准逮捕的人，都必须在逮捕后的二十四小时以内进行讯问。在发现不应当逮捕的时候，必须立即释放，发给释放证明。
