法律分析：风险代理，是指根据律师事务所与当事人约定，当事人暂不支付律师代理费用，或只支付部分律师费或前期差旅费用，待其债权实现或其他委托事项完成之后，再支付约定比例或一定数额律师费的代理形式。这种代理类型对双方来讲都存在一定风险，所以称之为风险代理。
法律依据：《中华人民共和国民法典》 第一百六十一条 民事主体可以通过代理人实施民事法律行为。
依照法律规定、当事人约定或者民事法律行为的性质，应当由本人亲自实施的民事法律行为，不得代理。
