首付款买房可以退吗？
释义
法律分析：
能退，如果在买房的时候，开发商违约是可以退首付的，比如说五证不全，或者说是合同上约定没有实现都是可以退首付的。还有就是个人原因，不过个人原因退首付是要付违约金的，比如说没有购房资格或者说在申请贷款没资格被拒，至于要出多少违约金，还需要跟开发商协商。
法律依据：
《中华人民共和国民法典》 第五百七十七条 当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
