释义	法律分析：副驾驶抽烟不罚款。副驾驶抽烟打电话不会扣分罚款,因为交通法规只规定了机动车驾驶员不得驾车吸烟、打手机,没有规定副驾驶要遵守这条规定,而且开车不能抽烟是因为抽烟要用手拿着影响对方向盘的操作,不能开车打电话也是类似原因,而副驾驶不掌握方向盘就不用禁止吸烟、打电话了。法律依据：《中华人民共和国道路交通安全法》第八十九条行人乘车人非机动车驾驶人违反道路交通安全法律法规关于道路通行规定的处警告或者5元以上51元以下罚款；非机动车驾驶人拒绝接受罚款处罚的可以扣留其非机动车。
