释义	抗辩权是指妨碍他人行使其权利的对抗权，至于他人所行使的权利是否为请求权在所不问。不可抗辩权是指当事人互负债务，有先后履行顺序的，先履行的一方有确切证据表明另一方丧失履行债务能力时，在对方没有履行或者没有提供担保之前，有权中止合同履行的权利。法律依据：《中华人民共和国民法典》第七百零一条保证人可以主张债务人对债权人的抗辩。债务人放弃抗辩的，保证人仍有权向债权人主张抗辩。
