释义	法律分析：离婚协议应当具体区分成立和生效，在完全自愿的前提条件下表达自己的真实意思所签订的离婚协议，从签字之日起成立；但离婚是要式法律行为，必须经过法定程序履行离婚登记手续，离婚才能完成，因此，只有经过婚姻登记机关登记的离婚协议，才能发生法律效力。法律依据：《中华人民共和国民法典》第一千零七十六条夫妻双方自愿离婚的，应当签订书面离婚协议，并亲自到婚姻登记机关申请离婚登记。离婚协议应当载明双方自愿离婚的意思表示和对子女抚养、财产以及债务处理等事项协商一致的意见。
