释义	法律分析：营业执照是不允许出租的，如果当事人出租，属于严重的违法行为。工商部门应责令改正，处4000元以下的罚款，情节严重的，撤销注册登记或者吊销营业执照。如果承租人产生法律后果，如欠款等，则当事人先承担，然后当事人才能向承租人追究。对于签订的营业执照出租合同，自始无效。法律依据：《个体工商户条例》第二十二条个体工商户提交虚假材料骗取注册登记，或者伪造、涂改、出租、出借、转让营业执照的，由登记机关责令改正，处4000元以下的罚款情节严重的，撤销注册登记或者吊销营业执照。
