释义	误工费是指赔偿义务人应当向赔偿权利人支付的受害人从遭受伤害到完全治愈这一期间（误工时间）内，因无法从事正常工作而实际减少的收入。工伤职工要求用人单位赔偿家属误工费没有法律依据。如果家属工作的单位扣了工资的，那么，家属护理职工的，可以要求护理费而不是误工费。法律依据：《中华人民共和国工伤保险条例》第三十三条用人单位应当支付的误工费仅限于工伤职工本人。工伤职工在治疗工伤，停止工作期间，原工资福利待遇不变，由所在单位按月支付。
