法律分析：商标到期后是不可以抢注的，商标到期并不意味着在法律上的正式注销，只有商标到期达一年以上，当事人都没有向商标局申请办理续展手续的，这种情况下才可以注册商标，而此时注册商标是正常的登记注册，并不属于抢注商标。
法律依据：《中华人民共和国商标法实施条例》 第四十七条 注册商标的注册人死亡或终止一年以上,未向商标局申请办理续展手续的,任何人可以向商标局申请注销该注册商标。
