释义	法律分析： 1、抽逃资金必须是投资者所为; 2、必须是投资者侵占了被投资企业的财产; 3、投资者侵占被投资企业的资产是偷偷进行的，不被人所知，比如：未进行恰当的帐务处理; 4、投资者侵占企业财产的目的是逃避对企业债务的担保责任; 5、由于投资者的行为，被投资企业的债权人利益受损(其债权被担保程度降低)而无法得知。法律依据：《中华人民共和国公司法》第二百零一条公司的发起人,股东在公司成立后,抽逃其出资的,由公司登记机关责令改正,处以所抽逃出资金额百分之五以上百分之十五以下的罚款。
