没签合同离职时候必须补签吗 |

法律分析：补签劳动合同只要没有违反法律强制性规定，那么就是合法有效的。其次公司与劳动者补签订劳动合同，合同应载明劳动合同的期限自双方建立劳动关系之日开始。公司虽在双方建立劳动关系之日起一个月内未与劳动者签订书面劳动合同，但在补签的合同中，双方约定的劳动合同的期限自双方建立劳动关系之日开始，该行为应视为劳动双方协商一致签订的劳动合同，权利义务同样适用于未签订劳动合同前的劳动关系存续期间，属于一种追认行为，可视为双方在建立劳动关系时已订立劳动合同。且该追认行为使双方未签订劳动合同前的劳动关系存续期间也同样受到劳动合同约定权利义务的规范。因此，公司将不承担支付劳动者双倍工资差额的责任。所以在补签劳动合同时最好能够和单位进行协商。
法律依据：《中华人民共和国劳动合同法》 第八十二条 用人单位自用工之日起超过一个月不满一年未与劳动者订立书面劳动合同的，应当向劳动者每月支付二倍的工资。用人单位违反本法规定不与劳动者订立无固定期限劳动合同的，自应当订立无固定期限劳动合同之日起向劳动者每月支付二倍的工资。
