释义	法律分析：要看是否构成刑事犯罪。交通肇事逃逸如果不涉及交通肇事罪的情况下，双方愿意私了达成赔偿协议，可以在交警处就赔偿问题达成协议，从而撤案。如果构成了交通肇事罪的，是不可以撤案的，不过就赔偿问题是可以协商私了的。法律依据：根据《刑法》第133条的规定，对交通肇事罪规定了三个不同的刑级（量刑档次）：犯交通肇事罪的，处3年以下有期徒刑或者拘役。交通运输肇事后逃逸或者有其他特别恶劣情节的，处3年以上7年以下有期徒刑。因逃逸致人死亡的，处7年以上有期徒刑。
