释义	法律分析: 产品责任，又称产品侵权责任，是指产品生产者、销售者因生产、销售缺陷产品致使他人遭受人身伤害、财产损失或有致使他人遭受人身、财产损失之虞而应承担的赔偿损失、消除危险、停止侵害等责任。法律依据: 《中华人民共和国产品质量法》第四十一条因产品存在缺陷造成他人损害的，生产者应当承担侵权责任。”依据以上规定，生产者只要其生产的产品存在缺陷造成他人损害的，除了法定可以减轻或免除责任事由外，不论缺陷产品的生产者主观上是否存在过错，都应当承担侵权责任。
