释义	法律分析：如果对年幼的或者患病的孩童拒绝扶养，情节恶劣，则具有扶养义务的人就构成遗弃罪。但如果是仅仅对这些儿童出于教育的目的进行恐吓，采用饿肚子的方式，则不能认为是拒绝扶养，也不算情节恶劣，一般不应认定为犯罪。法律依据：《中华人民共和国刑法》第二百六十一条犯遗弃罪的，处5年以下有期徒刑、拘役或者管制。因此，对于遗弃罪，行为人的行为及情节将对量刑起到很大的作用。
