监护人是对不能独立生活的限制民事行为能力人或无民事行为能力人负有监护义务的人，当被监护人有对他人的侵权等行为，由监护人按法律规定承担监护人责任，主体是监护人；而法定代理人是当被监护人需要从事一定民事法律行为时，其监护人以被监护人名义代理被监护人从事民事法律行为，主体是被监护人。
