释义	法律分析: 由于行为人不能抗拒的原因而引起，或者行为人不能预见的原因而引起的危害结果，都是行为人所无法避免的，当然不能让他负责任。这就是说，一个人的行为造成了危害结果，但经过调查以后证明，他既没有犯罪的故意，也没有过失，即无罪过，那么不管危害结果有多么严重，也不构成犯罪，不能追究刑事责任。法律依据: 《中华人民共和国刑法》第十六条行为在客观上虽然造成了损害结果，但是，不是出于故意或过失，而是由于不能抗拒或者不能预见的原因所引起的，不认为是犯罪。
