释义	法律分析：所开荒的土地到底是属于是国家所有，还是属于集体所有。对于开荒者来说，国家有法律规定，开荒者有权使用被开荒的土地，可以用来耕种，但不能用于建房。对于开荒地，一般是维持原有开荒者的使用权。但如果原有开荒者在开荒后又撂荒，后续的开荒者能否取得开荒地的使用权，要看前一个开荒者是否构成了撂荒的事实。法律依据：《中华人民共和国农村土地承包法》第四十四条不宜采取家庭承包方式的荒山、荒沟、荒丘、荒滩等农村土地，通过招标、拍卖、公开协商等方式承包的，适用本章规定。
