释义	法律分析：关于流押条款和流质条款的区别,本质上就是抵押权和质权的区别,抵押权不移转抵押物的占有,不影响使用。而质权是以交付质押物的占有为前提,因而出质人交付质押物后,即失去使用该质押物的机会,而负有保管义务的质权人又不得使用。法律依据：《中华人民共和国民法典》第四百零一条抵押权人在债务履行期限届满前，与抵押人约定债务人不履行到期债务时抵押财产归债权人所有的，只能依法就抵押财产优先受偿。
