不违法。
我国没有相关的法律规定酒店双人间住三个人是违法的行为，因此酒店双人间住三个人是不违法的。
有些酒店会有专门的规定，双人间不可以住三个人，但是大多数酒店没有相关规定，酒店双人间是否可以住三个人应当参照相关酒店的具体的规定。
法律依据：
《旅馆业治安管理办法》 第六条 旅馆接待旅客住宿必须登记。登记时，应当查验旅客的身份证件，按规定的项目如实登记。接待境外旅客住宿，还应当在24小时内向当地公安机关报送住宿登记表。
