释义	法律分析：所谓的“退捕”应当是“退补”，也就是退回补充侦查。退回补充侦查是检察院在审查案件中认为对部分证据需要补充侦查的，退回公安机关进行补充侦查的程序。法律依据：《中华人民共和国刑事诉讼法》第一百七十一条人民检察院审查案件的时候，必须查明：（一）犯罪事实、情节是否清楚，证据是否确实、充分，犯罪性质和罪名的认定是否正确；（二）有无遗漏罪行和其他应当追究刑事责任的人；（三）是否属于不应追究刑事责任的；（四）有无附带民事诉讼；（五）侦查活动是否合法。
