释义	法律分析：宅基地是农村的农户或个人用作住宅基地而占有、利用本集体所有的土地，所有权属于农村农民集体成员所有，本村村民只有使用权。法律依据：《确定土地所有权和使用权的若干规定》第五十二条空闲或房屋坍塌、拆除两年以上未恢复使用的宅基地，不确定土地使用权。已经确定使用权的，由集体报经县级人民政府批准，注销其土地登记，土地由集体收回。对非农业户口居民（含华侨）原在农村的宅基地，房屋产权没有变化的，可依法确定其集体土地建设用地使用权。房屋拆除后没有批准重建的，土地使用权由集体收回。
