地震房子倒了国家赔么 |
| 释义 |
房屋因地震等自然灾害造成倒塌的，如果受灾人员对房屋重建或者修缮有困难时，由地方政府为困难人员提供资金支持和技术支持。地震后房屋受损如果能修缮的，可以向政府申请修缮的补助款，如果变成危房不能居住的，由国家和地方政府进行相应的救济。
法律依据：
中华人民共和国国务院令第577号《自然灾害救助条例》
第十九条 自然灾害危险消除后，受灾地区人民政府应当统筹研究制订居民住房恢复重建规划和优惠政策，组织重建或者修缮因灾损毁的居民住房，对恢复重建确有困难的家庭予以重点帮扶。
居民住房恢复重建应当因地制宜、经济实用，确保房屋建设质量符合防灾减灾要求。
受灾地区人民政府民政等部门应当向经审核确认的居民住房恢复重建补助对象发放补助资金和物资，住房城乡建设等部门应当为受灾人员重建或者修缮因灾损毁的居民住房提供必要的技术支持。
第二十条 居民住房恢复重建补助对象由受灾人员本人申请或者由村民小组、居民小组提名。经村民委员会、居民委员会民主评议，符合救助条件的，在自然村、社区范围内公示;无异议或者经村民委员会、居民委员会民主评议异议不成立的，由村民委员会、居民委员会将评议意见和有关材料提交乡镇人民政府、街道办事处审核，报县级人民政府民政等部门审批。
