释义	法律分析：如果达不成离婚协议，或者一方不愿意离婚，主张离婚的一方可以到法院起诉离婚。法院判定是否准予夫妻俩离婚的依据是夫妻感情是否破裂。只要主张离婚一方有夫妻感情已经破裂证据，在法院调解无效前提，法院会判决准予离婚。在庭审时候，离婚双方当事人必须到庭。　法律依据：《中华人民共和国民法典》第三十二条　男女一方要求离婚的，可由有关部门进行调解或直接向人民法院提出离婚诉讼。
