释义	法律分析：是有可能构成非法销售假药、劣药罪的。法律依据：《中华人民共和国刑法》第一百四十一条生产、销售假药罪，是指生产者、销售者违反国家药品管理法规，生产、销售假药，足以危害人体健康的行为。根据刑法修正案八的规定，只要具有主观故意生产、销售假药的行为，即构成本罪。生产、销售的假药具有下列情形之一的，应当立案：含有超标准的有毒有害物质的；不含所标明的有效成份，可能贻误诊治的；标明的适应症或者功能主治超出规定范围，可能造成贻误诊治的；缺乏所标明的急救必需的有效成份的。
