释义	法律分析：没有被认定为工伤，申请工伤认定的职工或者其近亲属、该职工所在单位对工伤认定结论不服的，可以依法申请行政复议，也可以依法向人民法院提起行政诉讼。申请人申请行政复议，可以书面申请，也可以口头申请；口头申请的，行政复议机关应当当场记录申请人的基本情况。法律依据：《关于审理人身损害赔偿司法解释》第十二条依法应当参加工伤保险统筹的用人单位的劳动者，因工伤事故遭受人身损害，劳动者或者其近亲属向人民法院起诉请求用人单位承担民事赔偿责任的，告知其按《工伤保险条例》的规定处理。
