释义	法律分析：对于在网络上进行赌博的行为，在我国一般是认定为违法行为。而当达到了一定程度之后，那么才有可能构成《刑法》中的赌博罪。一般在网上参与赌博的拘留5天以下，情节严重的处10日以上15日以下拘留。法律依据：《治安管理处罚法》七十条以营利为目的，为赌博提供条件的，或者参与赌博赌资较大的，处5日以下拘留或者500元以下罚款;情节严重的，处10日以上15日以下拘留，并处500元以上3000元以下罚款。
