问题	用他人身份证证券是否犯法
释义	根据中华人民共和国身份证法第十六条规定有下列行为之一的，由公安机关给予警告，并处二百元以下罚款，有违法所得的，没收违法所得：（一）使用虚假证明材料骗领居民身份证的；（二）出租、出借、转让居民身份证的；（三）非法扣押他人居民身份证的。伪造、变造的居民身份证和骗领的居民身份证，由公安机关予以收缴。第十八条伪造、变造居民身份证的，依法追究刑事责任。有本法第十六条、第十七条所列行为之一，从事犯罪活动的，依法追究刑事责任。
