家庭暴力如果构成虐待情节恶劣的会构成犯罪，会构成虐待罪。虐待罪，是指经常以打骂、禁闭、捆绑、冻饿、有病不给治疗、强迫过度体力劳动等方式，对共同生活的家庭成员进行肉体上、精神上的摧残、折磨，情节恶劣的行为。

法律客观：

《民法典》第一千零九十一条有下列情形之一，导致离婚的，无过错方有权请求损害赔偿：（一）重婚；（二）与他人同居；（三）实施家庭暴力；（四）虐待、遗弃家庭成员；（五）有其他重大过错。
