释义	法律分析: 婚内出轨第三者一般不是违法行为，是受到道德上谴责的行为。但是如果第三者的行为是明知他人有配偶，还要与其登记结婚，或者是在外与有配偶者以夫妻名义同居，那么其行为就会因触犯刑法，构成重婚罪。第三者是没有犯法的，但如果要求赔偿的话，法律也会支持的；如果要离婚的话是可以要求赔偿的。《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
