释义	法律分析：已经设定抵押的房地产，经抵押权人同意，抵押房地产可以转让或者出租。法律依据：《城市房地产抵押登记管理办法》第三十七条抵押权可以随债权转让。抵押权转让时，应当签订抵押权转让合同，并办理抵押权变更登记。抵押权转让后，原抵押权人应当告知抵押人。经抵押权人同意，抵押房地产可以转让或者出租。抵押房地产转让或者出租所得价款，应当向抵押权人提前清偿所担保的债权。超过债权数额的部分，归抵押人所有，不足部分由债务人清偿。
