释义	法律分析：法律上暑假工不是劳动关系。学生在校外开展勤工助学活动中,学生勤工助学管理服务组织必须经学校授权,代表学校与用人单位和学生三方签订具有法律效力的协议书。生私自在校外打工的行为,不在本办法规定之列。法律依据：《中华人民共和国劳动合同法》第十条建立劳动关系，应当订立书面劳动合同。已建立劳动关系，未同时订立书面劳动合同的，应当自用工之日起一个月内订立书面劳动合同。用人单位与劳动者在用工前订立劳动合同的，劳动关系自用工之日起建立。
