释义	法律分析: pct专利申请流程: 1、由申请人向作为PCT受理局的国家局提出专利申请； 2、专利政部门受理PCT申请后，将对所申请的文件进行十八个月的形式审查； 3、审查合格后，送交世界知识产权组织国际局和国际检索单位做出检索报告，并进行国际公布。法律依据:《《中华人民共和国专利法》》第三十九条发明专利申请经实质审查没有发现驳回理由的，由国务院专利行政部门作出授予发明专利权的决定，发给发明专利证书，同时予以登记和公告。发明专利权自公告之日起生效。
