释义	法律分析：申请人多缴、错缴或者重缴专利费用的，在缴费之日起一年内向专利局提出的，经专利局核实后应当退款。超过一年以后提出的，一般不再予以退款。申请人缴纳了某种程序的费用，但事实上该程序未启动时，也可以请求退款。法律依据：《中华人民共和国专利法》第三十五条发明专利申请自申请日起三年内，国务院专利行政部门可以根据申请人随时提出的请求，对其申请进行实质审查；申请人无正当理由逾期不请求实质审查的，该申请即被视为撤回。国务院专利行政部门认为必要的时候，可以自行对发明专利申请进行实质审查。
